Terms of Use

These Terms of Use (the "Terms") govern access to and use of the Kota Booking platform, including all websites, mobile applications, and API services provided by "EDM" d.o.o. Sarajevo, Kalmija Baruha Street No. 1, Sarajevo, Bosnia and Herzegovina (ID No.: 4202898560003, Court Register No.: 65-01-0459-21), hereinafter referred to as "Kota Booking", "we", or "us".

By accessing or using the platform, you confirm that you have read, understood, and accepted these Terms in full. If you do not agree with these Terms, please stop using the platform.

These Terms apply to all users, including business account owners ("Subscribers") and end users who book appointments through the Kota Booking platform ("Clients").

Kota Booking is an appointment management platform intended for small and medium-sized businesses. The platform provides the following functionality:

• Online appointment booking through a public link • Client management and visit records (CRM) • Analytics and business performance overview • Automated reminders and notifications • Management of services, staff, and working hours • Calendar integration and schedule synchronization

Kota Booking reserves the right to modify, suspend, or discontinue any part of the service at any time, with prior notice to subscribers within a reasonable period.

To use the platform as a subscriber, you must create an account. During registration, you are required to:

• Provide accurate, complete, and up-to-date information • Choose a secure password and keep it confidential • Notify us immediately of any unauthorized access to your account

Each account may be used by only one legal or natural person. Sharing access credentials with third parties is prohibited. You are responsible for all activities carried out through your account.

You may create an account only if you are at least 18 years old or otherwise have the legal capacity to do so. By registering, you confirm that you meet this requirement.

Kota Booking offers a 7-day free trial for new users, followed by paid subscription plans. Prices, functionality, and conditions of individual plans are available on the plans and pricing page.

Payment is charged in advance according to the selected billing period (monthly or annual). All prices are stated excluding VAT, which is charged in accordance with the applicable regulations of Bosnia and Herzegovina.

You may cancel your subscription at any time. After cancellation, the account remains active until the end of the paid period; no refunds are issued for unused time. Kota Booking reserves the right to change prices with at least 30 days' prior notice.

In the event of non-payment or failed collection, Kota Booking reserves the right to temporarily or permanently suspend the account.

By using the platform, you agree that you will not:

• Use the platform for unlawful purposes or in a way that violates the laws of Bosnia and Herzegovina or applicable international regulations • Send spam, fake bookings, or misuse the notification system • Attempt to gain unauthorized access to systems, accounts, or third-party data • Interfere with the operation of the platform or its infrastructure • Collect data automatically (web scraping) without explicit written permission • Falsely present yourself as another person or entity • Distribute malicious software or carry out security attacks

Violation of these provisions may result in immediate account termination and legal action under applicable law.

All platform content, including code, design, logos, text, graphics, and databases, is the property of "EDM" d.o.o. Sarajevo and is protected by copyright and intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable license to use the platform solely in accordance with these Terms.

Content that you enter into the platform (client data, services, schedules) remains your property. You grant us permission to process that content solely for the purpose of providing the service.

The platform is provided on an "as is" and "as available" basis, without any express or implied warranties.

Kota Booking does not guarantee: • Uninterrupted, secure, or error-free platform availability • The accuracy or completeness of data entered by users • Specific business results arising from use of the platform

Kota Booking is not liable for losses arising from service interruptions, data loss, third-party errors, or force majeure events.

To the maximum extent permitted by applicable law, the total liability of "EDM" d.o.o. Sarajevo to you for any claim arising from use of the platform is limited to the amount you paid for the service during the 12 months preceding the event giving rise to the claim.

In no event shall Kota Booking be liable for indirect, incidental, special, or consequential damages, including loss of revenue, loss of data, or loss of business opportunity.

You may stop using the platform and close your account at any time through your account settings or by sending a request to support@kotabooking.com.

Kota Booking may terminate or suspend your access in the event of a breach of these Terms, non-payment, or justified business reasons, with prior notice where reasonably possible.

After account closure, your data is retained in accordance with the Privacy Policy and applicable legal obligations, and is then permanently deleted.

These Terms are governed by and interpreted in accordance with the laws of Bosnia and Herzegovina.

Any dispute arising out of or in connection with these Terms will first be resolved amicably where possible. If an amicable solution is not reached within 30 days from the date the dispute arises, the competent court in Sarajevo shall have jurisdiction.

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force and effect.

Kota Booking reserves the right to amend these Terms at any time. We will notify you of any changes by email or through an in-platform notice at least 14 days before they take effect.

Continued use of the platform after the effective date of the changes constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
